MINUTES OF THE EUREKA CITY COUNCIL MEETING
May 4, 2009

The Eureka City Council convened in regular session at the City Building on May 4, 2009, at 7:30 p.m. Mayor Scott Punke called the meeting to order and led The Pledge of Allegiance and then directed the City Clerk to call the roll. Present were Aldermen Waters, V. Punke, Kupfer, Zeltwanger, Hinnen, Meares, Hinthorne and Prather. Also in attendance were Lynn Hinnen, Treasurer; Marilyn Walter, City Clerk; Jim Lehman, Director of Public Works; Chief Al Misener; and Anne Sandvik, City Administrator.

Moved by Hinnen, second by Meares, to approve the minutes of the April 20, 2009, regular meeting of the City Council. Passed on roll call vote with Hinnen, Meares, Waters, V. Punke, Kupfer, Zeltwanger, Hinthorne, and Prather all voting Aye.

The Mayor asked for public comments on any action to be taken on Agenda items. There were none.

Moved by Waters, second by V. Punke, to approve and pay the semi-monthly bills to be dated April 30, 2009 as the City’s obligation in the amount of $186,288.09. This is to keep the expenses in the correct Fiscal Year of 2008-2009. Passed on roll call vote with Waters, V. Punke, Kupfer, Zeltwanger, Prather, Hinnen, Meares, and Hinthorne all voting Aye.

Moved by Waters, second by V. Punke, to approve and pay the semi-monthly bills to be dated May 1, 2009 as the City’s obligation in the amount of $249,805.23. This is to keep the expenses in the correct Fiscal Year of 2009-2010. Passed on roll call vote with Waters, V. Punke, Kupfer, Zeltwanter, Prather, Hinnen, Meares, and Hinthorne all voting Aye.

Moved by Meares, second by Hinnen, to approve Ordinance 09-06—an ordinance amending the Eureka Municipal Code Zoning Ordinance with the addition of Section 17.13.1 – Rate Fee Structure, Permit, & Inspection Fees charged for all construction within the City of Eureka requiring a building permit per the Eureka Municipal Code Zoning Ordinance. This is recommended by the Administration Committee. Passed on roll call vote with Meares, Hinnen, V. Punke, Kupfer, Zeltwanger, Hinthorne, and Prather all voting Aye. Waters voted Nay.

The Mayor made a presentation to V. Punke who is leaving the Council:  A copy of the City of Eureka Elected Officials from 1859 through 2009 and the City will purchase a brick to be placed in the plaza at the intersection of Rts 24 and 117 and will have printed V. Punke, Alderman, Ward 2, 2005-2009.

Moved by Hinnen, second by Kupfer, to recess the Council meeting for the swearing-in ceremony for newly elected officials: Mayor Scott Punke, City Clerk Marilyn Walter, City Treasurer Lynn Hinnen, Aldermen Rich Waters, Jim Meares, Nate Zeltwanger, and Zach Sancken. All voted Aye. Mayor Punke swore in the City Clerk, The other newly elected officials were sworn in by Marilyn Walter, City Clerk.

Moved by Hinnen, second by Meares, to reconvene the meeting. All voted Aye.

Mayor Punke directed the City Clerk to call the roll. Present were Aldermen Waters, Meares, Kupfer, Zeltwanger, Hinnen, Hinthorne, Prather, and Sancken, Also in attendance were Lynn Hinnen, Treasurer; Marilyn Walter, City Clerk; Jim Lehman, Director of Public Works; Chief Al Misener; and Anne Sandvik, City Administrator.

Mayor Punke asked if there was any new business to come before the Council. There was none.

Keith Leman of 606 Crestwood Drive addressed the Council with concerns on the street work on his street. Several residents of that street were also present and some spoke to the problems with the tar and chip surface on this street. They presented a petition from the residents on Crestwood. They want an asphalt overlay on the street. Waters and Mayor Punke explained the rational and monetary restraints. Mayor Punke apologized for the problems this chip and tar has caused. Prather, their alderman, spoke to the residents about his concern over the surface of this street and asked the Maintenance Committee members to walk the street also. This was done late in October so there wasn’t enough warm weather to cure the surface.  There was much discussion on this problem. Waters will put this in the Maintenance Committee meeting in the very near future. Keith Leman wants communication from the City concerning what is being done concerning this problem.

Moved by Meares , second by Prather, to approve the mayor’s appointment of Alan Hinnen to the Eureka Planning and Zoning Commission for the term of May 1, 2009 to April 30, 2014. All voted Aye.

Moved by Kupfer, second by Meares, to approve the mayor’s appointment of Stan Wertz to the Eureka Planning and Zoning Commission for the term of May 1, 2009 to April 30, 2014. All voted Aye.

Moved by Sancken, second by Hinnen, to approve the Mayor’s appointment of Management Personnel beginning May 1, 2009 through April 30, 2010 for Al Misener, Chief of Police; Jim Lehman, Director of Public Works; Anne Sandvik, Acting City Administrator. All voted Aye.

Moved by Meares, second by Kupfer, to approve the Agreement for Zoning Administrative services and Building Inspector services with Mark Maloney. This is recommended by the Administration Committee. All voted Aye.

Moved by Meares, second by Hinnen, to approve the mayor’s appointment of Dennis Kroll and Nancy Aldridge as members of the Eureka Liquor Commission for the term of May 1, 2009 to April 30, 2010. All voted Aye. Mr. Kroll took the oath of office. Ms. Aldridge was not present.

Moved by Hinnen, second by Kupfer, to approve Marilyn Walter’s recommendation for the appointment of Jennifer Davis as Deputy City Clerk. All voted Aye.

Moved by Hinnen, second by Hiinthorne, to approve the mayor’s appointment of Rich Waters as the Budget Officer for the City of Eureka. All voted Aye.

Moved by Hinnen, second by Zeltwanger, to approve Ordinance 09-05 Identity Theft Prevention Program and Policy. This is recommended by the Enterprise Committee. Passed on roll call vote with Hinnen, Zeltwanger, Waters, Meares, Kupfer, Hinthorne, Prather, and Sancken all voting Aye.

Moved by Meares, second by Kupfer, to approve Proclamation P-09-01 proclaiming May 10 through May 16 as National Police Week and May 15 as Peace Officer’s Memorial Day in Eureka. Passed on roll call vote with Meares, Kupfer, Waters, Zeltwanger, Hinnen, Hinthorne, Prather, and Sancken all voting Aye.

Moved by Meares, second by Hinnen, to approve a donation of $1,500 to the Eureka Area Food Pantry. This is recommended by the Administration Committee and will come from their budget. Passed on roll call vote with Meares, Hinnen, Waters, Kupfer, Zeltwanger, Hinthorne, Prather, and Sancken all voting Aye.

Committee Reports:
Chairman Waters of the Budget Committee: No report.

Chairman Meares of the Administration and Personnel Committee: No report

Chairman Hinnen of the Enterprise Committee: No report.

Chairman Waters of the Maintenance Committee: Will schedule a meeting very soon. Waters is having surgery May 6. He asked Prather to chair the meeting and asked Anne to have Cullinan here since something was not done right on Crestwood Drive.

Public Safety Committee: Nate Zeltwanger is the new chair of this committee.

Chairman Hinnen of the Park and Recreation Committee: No report.

Chairman Kupfer of the Economic Development Committee: No report.

Chairman Mayor Punke of the Liquor Committee: All of the liquor licenses were renewed except for Rosie’s Restaurant. She will be closing the business on Friday.

Chair Hinthorne of the Communications Committee: Hinthorne reported that the volunteers are needed for sales of Sesquicentennial items at IGA. May 30 is the City-wide garage sale. Signs are up at all entrances of town. May 16 is the Paws for a Cause and Eureka 1859. The Ping Pong Power Ball will be drawn on July 4 as will the car raffle.

New Business: The Lake was shocked today by the Department of Natural Resources. The fishery is very healthy. The DNR says that we need to allow weeds to grow in the Lake for the fish species to stay healthy.

Public Comments: Zach said he is glad to be back on the Council.

There being no further business to come before the Council the meeting adjourned at 8:45 p.m.
