The Eureka City Council convened in regular session at the City Building on September 21, 2009, at 7:30 p.m. Mayor Scott Punke called the meeting to order and led The Pledge of Allegiance and then directed the City Clerk to call the roll. Present were Aldermen Kupfer, Zeltwanger, Hinnen, Hinthorne, Prather, Sancken, and Waters. Alderman Meares was absent. Also in attendance were Marilyn Walter, City Clerk; Jim Lehman, Director of Public Works; Chief Al Misener; and Anne Sandvik, City Administrator.
Moved by Hinnen, second by Kupfer, to approve the minutes of the September 8, 2009, regular meeting of the City Council. Passed on roll call vote with Hinnen, Kupfer, Zeltwanger, Hinthorne, Prather, Sancken, and Waters all voting Aye.
The Mayor asked for public comments on any action to be taken on Agenda items. There were none.
Moved by Waters, second by Hinthorne, to approve and pay the bills for expenses of the City’s obligation in the amount of $71,835.47. Passed on roll call vote with Waters, Hinthorne, Kupfer, Zeltwanger, Hinnen, Prather, and Sancken all voting Aye.
Moved by Waters, second by Kupfer, to accept the Treasurer’s Report as presented for the month ending August 31, 2009. Passed on roll call vote with Waters, Kupfer, Zeltwanger, Hinnen, Hinthorne, Prather, and Sancken all voting Aye.
Moved by Hinnen, second by Sancken, to approve the Liquor Commission’s recommendation to issue a Class I Catering License for Sodexo America LLC, Eureka College food service provider. Marc Pasteris, the Financial Officer at Eureka College, thanked the Council for offering this type of license for their catered events—reunions, wedding receptions, alum events, etc. Kupfer clarified that food will be served when liquor is served. Sancken noted that this will be a benefit to our community since many of these events are now held out of town because liquor cannot be served. This will help to keep the business and our citizens in town. Passed on roll call vote with Hinnen, Sancken, Kupfer, and Waters all voting Aye. Zeltwanger, Hinthorne, and Prather voted Nay. The motion passed 4 to 3.
Moved by Hinnen, second by Kupfer, to approve Ordinance 09-11 An Ordinance allowing the quarterly reports by restaurants for food to alcohol sales to be based on the business’s reporting period for its quarters. This is recommended by the Liquor Commission. Since the license is May 1 through April 30, we were basing the quarters starting with May. Passed on roll call vote with Hinnen, Kupfer, Zeltwanger, Hinthorne, Prather, Sancken, and Waters all voting Aye.
Moved by Zeltwanger, second by Hinthorne, to approve the recommendation from the Public Safety Committee to designate three handicapped parking spaces on Major Street in front of Eureka Community Hospital. Passed on roll call vote with Zeltwanger, Hinthorne, Kupfer, Hinnen, Prather, Sancken, and Waters all voting Aye.
Moved by Zeltwanger, second by Prather, to approve the recommendation from the Public Safety Committee to designate no parking on the South side of Campus Street. Passed on roll call vote with Zeltwanger, Prather, Kupfer, Hinnen, Hinthorne, Sancken, and Waters all voting Aye.

Chairman Meares of the Administration and Personnel Committee: Meares was absent. No report
Chairman Hinnen of the Enterprise Committee: Need to set a meeting after Council
Chairman Waters of the Maintenance Committee: Reminder of Ward 2 Junk Day the week of September 28. Items must be on the curb by 7:30 a.m. on Monday.
Chairman Zeltwanger of the Public Safety Committee: A meeting was held September 14. Many issues were discussed. Non-licensed aircraft over the city is being discussed and monitored.
Chairman Hinnen of the Park and Recreation Committee: No report
Chairman Sancken of the Economic Development Committee: No report
Chairman Mayor Punke of the Liquor Commission: No report
Chairperson Hinthorne of the Communications Committee: No report
New Business: The Mayor reminded us that Taste of Eureka is Friday, September 25, from 4:30 to 7 p.m. There will be a band on the Court House lawn and entertainment at the AC Home.
