MINUTES OF THE EUREKA CITY PLANNING & ZONING COMMISSION
May 17, 2007
The meeting was called to order at 7:00 p.m. by Acting Chairman, Al Hinnen. Present were: Wertz and Cuffe. Mr. Simenc and Mr. Knepp were absent. Also present were: Don McKnight, Karen McKnight, Darrell Bayne, Virgil Chambliss, Jerry Riley, Tom Stoltz, Randy Crump, Scott Johnson, Ken Pyle, Kurt Blunier, Mike and Donna Sweeney and Mayor Punke.
The minutes of the April 19th meeting were moved for approval by Cuffe with the addition of Jamie McFarlen to the list of those present that evening. Second, Wertz.
All voted yes.
The signage for the Corner Stone Restaurant at the West Side Business Park was moved for approval by Mr. Cuffe with the stipulation the site plan show the exact distance from the West and South property lines where the sign will be set. Second Wertz. All voted yes.
The request to consider allowing the Corner Stone Restaurant to put in a gravel parking lot instead of paving at this time was discussed. Mr. Cuffe felt they could not deviate from the original plan in this regard. If they allow them an occupancy permit before the parking lot was paved the City did not have any leverage in the future to force them to put one in. Mr. Cuffe made the motion to allow the Corner Stone restaurant to change from the original plan for a paved parking lot to a gravel lot. Second Wertz. Cuffe – No, Wertz- No, Hinnen – No. Motion failed
A hearing was held to consider the Variance request from Scott Johnson at 100 Grandview Terrace to allow the garbage dumpster to remain in the front yard. The Commission received a petition signed by a majority of the residents in the area opposing the variance and allowing the garbage dumpster to remain in the front yard. After review of the petition and comments from the residents present Mr. Cuffe made a motion to approve the Variance request from Mr. Johnson to place the garbage dumpster in the front yard. Second Wertz. Cuffe – No, Wertz- No, Hinnen – No. Motion failed.
The hearing to consider the zoning change from R-1 for 305 Hilldale to R-2 to keep the High School property zoning consistent was considered and the parking lot plans for the property at 305 Hilldale. The school has provided the requested information from the Commission at its December meeting. The School is providing underground storage greater than what is required for this lot to slow the flow of water even more than what is estimated for a ten year water event. They were required to meet the twenty-five year water event. This they hope will help alleviate the downstream effect of the current retention basin and flow. The School will work with the City to take a look at the current retention basin and drainage problem experience by the homes downstream to the West. The residents were concerned with the additional flow from the parking lot and screening and access off of Hilldale. Mr. Cuffe made the motion to approve the parking lot design as submitted with the stipulation the School will plant sufficient size evergreen trees along the West and South side of the parking lot for screening and will block the access off of Hilldale. The School will also place additional trash receptacles in the area. The School and the City will work together to find a solution to the water flow from the current detention basin on the school property. Second Hinnen, Cuffe – Yes, Hinnen- Yes, Wertz – No. Motion passed.
It was moved by Cuffe, second by Hinnen to approve the zoning change for the property at 305 S. Hilldale from R-1 – Single Family Residential to R-2 Multi-Family Residential. The property was purchased by the school and the change will keep the zoning consistent in the area. The school property is zoned R-2. Cuff – Yes, Hinnen – Yes, Wertz – No Motion passed
It was moved for adjournment by Mr. Cuffe, second Wertz.
