MINUTES OF THE EUREKA CITY PLANNING & ZONING COMMISSION
June 21, 2007
Present: Chair Mick Simenc, Al Hinnen, Ken Knepp, Stan Wertz, Jim Cuffe Also present: Jerry Yoder, Craig Gerdes, Glade Stutzman, and his son.
Moved by Knepp, second by Wertz, to approve the May 17 minutes. All voted Aye.
Item #3: Consideration of the request to subdivide several lots at Parkway Drive at the Knolls by Jerry Yoder and recommendation to the City Council to approve Resolution 07 -06-An agreement between the City and Jen-y Yoder for the subdivision of the property.
Using the plat that the commission members had in their packets, Jerry explained what they want to do. He paid 115 of cost of the sewer line along his property a few years ago. Yoder did dedicate the roadway (titled Yoder Drive on this plat) to the north of his and Craig Gerdes' property to the City at the June 18 Council meeting. Gerdes owns Tract JD and JD 1. The City will be blacktopping "Yoder Drive" this summer and has promised to widen that road as well in the future. Gerdes wants to buy Yl and Y2. Gerdes and Yoder want to be sure that in future years this would be able to be sold and the buyer be able to build there.
The City has annexed 20 acres of Jerry's property which includes Jerry's house. At the time Jerry worked on trust with City Manager Rich Walker and Mayor Laura Siscoe. It was not put on paper. Recently Jerry talked to Siscoe who says she will verify this transaction. It does need to be in writing. There are 54 acres of heavier timber that are not in the City.
Tony Dowiatt, City Engineer, has indicated that the water line is large enough for the homes on these lots and has drawn out the sewer line that would have to be added-along the golf course. In the future if the lots are sold, the developer would be responsible for the water and sewer though the resolution says that currently that is the case.
Jim feels that the Commission needs to see the big picture for the 65 acres so the infrastructure can be designed ahead of time with consideration for future development including streets, city services, emergency services, etc. One question is: has the fire department checked to see if a truck can get down the road especially if more houses are added. All of Parkway Drive may even be a problem for the fire department.
The resolution leaves many questions: Where does the number ~for the acreage come from? Jerry said he has 74 acres. Has the fire department access been considered? Can a fire truck turn around there? The resolution says that Yoder is responsible right now for the development of sewer, water etc. What about a cul-de-sac at the end of "Yoder Drive"? (then Lot 2 and 3 could be owned by two people). It looks like Lot 2 couldn't get to their home if Lot 3 is sold to someone else.
This resolution must be tabled until answers are obtained from Anne, and it may have to be rewritten. There is a contradiction between the plat and the resolution. None of the lots are listed in the resolution. The resolution-last paragraph-says that the plat shows 65 acres and it doesn't.
Glade Stutzman is to purchase Lot Y3 and had a couple of questions about the sewer line. How does he get the sewer to his house?
Cuffe moved to table the plat and resolution until the July meeting and more information is obtained from Anne and Tony for clarification. We need a full plat of the 65 acres as the resolution says. Knepp second. All voted Aye.
A special meeting could be called after this is worked out and the questions are answered to expedite this matter.
Tract Y is easements and should be identified in the resolution. Gerdes and Yoder think the road does not go into Lot 3 so perhaps the plat is wrong. "Yoder Drive" isn't the name-it is Parkway Drive. The legal description says "Yoder Drive" which is not correct.
Item #4: Consideration of Ordinance 07-08 amending the Zoning Code - Special Use with the Addition of Procedure for Consideration of a Special Use/Zoning Change/Variance or request requiring a Public Hearing by the Eureka Planning Commission.
This is to make a correction that the public does not know about these meetings. This allows for a Public Notice Sign on the property. These signs should have been on Yoder property so the neighbors would know what is going on. Perhaps the neighbors don't want this subdivision.
This ordinance amends the Municipal Zone Code Title 17. The committee feels this is a very good change. Number D3 of the Ordinance needs to be changed to indicate it is visible to the public and where the signs should be posted. Three large signs must be posted - in the yard and at the two closest intersecting streets. Sign should be in bright orange-plastic laminated so you can write on it.
Knepp moved to approve Ordinance 07-08 with amendments listed above. Cuffe second. All voting Aye.
Agreement was supposed to be drawn up about water drainage plan for the flood plan being used by the School District. Is this being done?
Item #5: Review of Special Use.
A. Hinnen moved to table this review, Simenc seconded. All voted Aye.
There is a check list that is to be followed before information is brought to the Planning Commission.
