MINUTES OF THE EUREKA CITY PLANNING & ZONING COMMISSION
August 16, 2007
The meeting was called to order by Chairman Mick Simenc, present were Cuffe, Knepp, Hinnen and Wertz. Also present were Chief Misener, Anne Sandvik, Jerry Riley and Mark and Danielle Wiegand.
The minutes of the July 19th and August 2nd meetings were moved for approval by Wertz with the change in the first section Moot should be Mooty. Second Knepp. All voted yes
The Planning Commission held a public hearing to consider the Special Use request from Mark Wiegand to house a horse/livestock within the corporate limits of the City of Eureka. Mark Wiegand explained the request was made due to the fact they had contacted the zoning department and were told they could have a horse on their property. Mr. Wiegand found out after he had built the fence and moved the horse onto the property that the housing of livestock in town is not allowed. Mr. Wiegand originally contacted Woodford County instead of the City of Eureka and was misinformed. Mr. Wiegand stated that his neighbors did not have a problem with the horse and asked that the Commission grant his request.
During discussion Mr. Cuffe stated “to allow the Variance would set precedence. The City currently has chickens in a residential neighborhood which are being moved. There was also an individual who wanted to breed and raise dogs in the corporate limits and his request was denied. To allow one residence to have livestock would open the door for all others who want livestock. Mr. Cuffe regretted the misunderstanding and the Administrator was asked by Mr. Knepp to contact the County Zoning Department and have a discussion on how this can be avoided in the future.
Mr. Cuffe moved that the consideration of approval of a Special Use request from Mark Wiegand to allow the housing of a horse/livestock at 947 W. Center Street be approved. Second Hinnen. Roll call vote Cuffe – no, Hinnen – no, Wertz – no, Simenc – no, Knepp – no. Motioned failed.
It was moved by Hinnen to adjourn the meeting at 7:28 p.m. second Cuffe. All voted yes.
