MINUTES OF THE EUREKA CITY PLANNING & ZONING COMMISSION
November 19, 2009
The meeting was called to order at 7:00 p.m. by Chairman Mick Simenc. Present were Hinnen and Cuffe. Mr. Wertz and Mr. Knepp were absent. Also present were Don Litwiller, Tina Schreyer, Curt Litwiller, Dennis Litwiller, Jerry Riley and Mark Wiegand.
The minutes from the October 15th meeting were moved for approval by Hinnen, second by Cuffe. All voted yes.
The hearing for a Special Use request by Evan and Tina Schreyer of 945 West Center, Eureka, IL 61530 to operate a Day care Center in her home in an R-1 Residential District was held.
The committee discussed the request from Tina Schreyer. Mrs. Schreyer would like to have a licensed day care approved by the Department of Family Services in her home. She would have a maximum of 12 children during the day and up to 16 with after school care. Mrs. Schreyer would also provide day care for second shift families. She would put up a 6 foot privacy fence in the rear yard and would provide a play area. She has separate parking for up to 6 cars next to her home. The property to the east of her home is commercial property. Mark Wiegand was present to and expressed his concern with the noise level, traffic, loss of privacy and that there was a small frontage road used by the 3 homes. He was also concerned with a day care in this area due to the highway being so close. He worried that his two boys riding their bikes on the frontage road would become hazardous with the traffic. It was moved by Cuffe and second by Hinnen to approve the request for a special use permit to operate a day care by Mrs. Schreyer. Roll call. Cuffe – no, Hinnen – no, Simenc – no. Motion was defeated.
Don Litwiller wanted some clarification on what would be allowed under the zero lot development. He would like to market several properties for zero lot development. The City has an ordinance allowing zero lot development but the lots to be used must be approved by the Planning Commission to control where they would be allowed. Don asked if the College Subdivision lots zoned R-2 would qualify if they met the minimum requirements. There were 20 - R-2 lots available in the College Park Subdivision. The Commission would consider the lots in question but would like to designate the number of lots used for this purpose. The Commission members wanted to table the discussion until all the commission members were present.
Don Litwiller requested that he be able to use 6 inch water pipe instead of the required 8 inch water pipe for his two subdivision; Lakeview Acres 14-B and Lakeview Acres 15. This would make the water lines in the Lakeview area all 6 inch. When he first proposed the subdivision years ago and approved by the Planning Commission, Don purchased the water and sewer pipe for he entire development. The City placed a moratorium on subdivision development in 2001 and then changed the ordinance requiring the 8 inch water pipe instead of the 6 inch. The Commission discussed Don’s request and Mr. Hinnen made the motion to allow Lakeview Developers to use the 6 inch water line for the Lakeview acres section 14-B and 15 only and if the pipe met the City’s specifications, second Mr. Cuffe. All voted yes. The commission also stated any future development would require the 8 inch water mains.
It was moved by Hinnen and second by Cuffe to adjourn the meeting at 7:55 p.m. All voted yes.
