MINUTES OF THE EUREKA CITY PLANNING & ZONING COMMISSION
January 21, 2010

The meeting was called to order at 7:03 p.m. by Chairman Mick Simenc. Present were Hinnen, Cuffe and Knepp. Mr. Wertz was absent. Also present were Milt and Lynn Hinnen, Roger Miller, Travis Stapleton, Jerry Riley, Michelle Goggins and her son.

The minutes were moved for approval by Hinnen with the addition of Dennis Litwiller as present at the last meeting, second Cuffe. All votes yes.

The hearing for the consideration to allowing a pet shop at 302 N. Liberty by Michelle Goggins was opened. Comments from the public were as follows:

  1. Parking on the street by patrons. There was a problem now with the Goggins parking their cars behind one of the driveways on Meek Street. They were concerned with the additional parking with a business here.
  2. There was a lot of truck traffic on this road and parking could be a problem with the trucking companies using this street to load and unload. The fuel trucks back up the street after filling fuel tanks located at the end of Meek Street. The garbage trucks also use this street along with the Olio Township maintenance building located at the end of this street.
  3. The use of the alley to access parking in the rear yard of the home. One of the business and homeowners in the area use the alley to access their property. Parking would be required to be off the alley on the property if the rear yard were to be used for parking.
  4. There was also a letter addressed to the Commission with several concerns. (See attachment
  5. The answers are as follows:
    1. There would be no cats or dogs sold.
    2. This is a new business and not being moved from one location to this one. Ms. Goggins explained that she is bi-polar and working in a location outside of her home would be difficult for her and it works better for her to have this business locate at her home.
    3. The Baers’ also felt there was a lot of traffic on this street already with the current businesses located at the end of Meek.
    4. The Department of Agricultural will inspect the property before giving her a license to operate a pet shop.
  6. Another concern was health safety issues with a business of this type located in a residential home.
  7. The public hearing was closed at 7:30.

The Commission considered the request to open a pet store by Ms. Goggins at 302 N. Liberty.

Mr. Knepp was concerned with traffic and parking problems. Maybe they could post no parking on both sides of North Liberty in this block. Other questions by the Commission. Ms. Goggins was asked what type of control she had to keep the animals safe and in control, fire and what health safety issues requirements were there. The Administrator was asked to contact the Health Department and the Department of Agriculture to answer the questions on life safety, restroom facilities, fire and health issues. The Commission would also like a letter from the owner of the property on his opinion on the use of the home as a pet store. The off-street parking needed to be addressed. The consideration of the request to open a pet store was tabled until the next meeting so the Commission could be provided additional information.

The Commission discussed zero lot line development within the Community. The consensus was that the members were not convinced there was a need in Eureka and limiting the areas to be allowed zero lot line developments after you begin approval in one area. They could be asked to allow zero lot line in other areas in town and if the commission disapproved, the next question would be why not here if allowed elsewhere in town. The Commission was also concerned with the joint ownership and maintenance of the property. The Commission asked to have Don Litwiller provide the Commission with the covenants that he uses with the sale of a zero lot line property.
